Booking Terms & Conditions

Read this agreement thoroughly and carefully before booking a retreat with Shamasha.

Reservations

You may reserve a spot on any of our retreats via our website and online booking platform or by emailing daphnemarch2020@gmail.com

By reserving a spot with Shamasha, the participant acknowledges they have considered the potential risks, dangers and challenges, and expressly assumes the risks attendant to such conditions as may be experienced. 

By creating a reservation on behalf of other participants, you are deemed to be the designated contact person for every participant included in that reservation. This means that you are responsible for making all payments due in connection with your upcoming retreat, notifying Shamasha if any changes or cancellations are required and keeping your party informed.

All bookings are subject to availability.

Pricing

  • All retreats, day tours and services are priced in CAD (Canadian Dollars). 
  • All retreats, day tours and services are subject to NL HST of 15% 

Payment

  • Payments can be made via credit card or e-transfer.

Retreats

  • All muiltiday retreats require a 25% non-refundable deposit at the time of booking to secure your spot. 
  • The final payment is due 30 days prior to departure. 
  • If your reservation is made within 30 days of departure, the entire cost must be paid at the time of booking. 
  • All retreats require minimum 6 people to be confirmed to run. We will confirm this with you 30 days prior to the retreat. 

Day Tours

  • All day tours are paid in full at the time of booking. 
  • All day tours require a minimum of 2 people to go ahead. 

Cancellation & Refund Policy

To cancel your booking, you must submit your request to us in writing by email at daphnemarch2020@gmail.com. All booking changes, modifications, or cancellations must be submitted via email otherwise will not be accepted.

Cancellations by You

No refunds will be provided for any unused portion of the retreat once the trip begins, including if you leave a retreat for any reason or have to be removed from our retreat. 

There are no exceptions to this cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. 

No refunds for personal expenses: You will not be reimbursed for any personal expenses such as airfare, hotel or other travel expenses due to changes in itineraries or tour cancellations.

For this reason, we strongly encourage you to purchase trip cancellation and interruption insurance.

Retreats 

  • Cancellation up to 30 days prior, deposit non-refundable, can be credited toward future bookings. 
  • Cancellation within 30-15 days prior, 50% of the total payment is refundable. 
  • Cancellation within 14 days prior, 0% of the deposit and 0% of the final payment is refunded. 
  • If you do not notify us of a cancellation or change of group size before the retreat starts you will be charged the full balance of the booking. 

Day Tours & All Other Services

  • Cancellations up to 14 days prior, full refund
  • Cancellations 13-2 days prior, 50% of the total payment is refundable.
  • Cancellations within 48 hours, 0% of the total payment is refunded. 

 

Cancellations or Changes by Shamasha and Flexibility

We reserve the right to cancel, alter or modify any retreat or day tour without prior notice for the safety and/or comfort of clients. You acknowledge that the amenities, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, and border crossing problems, pandemics and other unforeseeable factors. 

Retreats 

  • We will provide no less than 30 days notice for cancelling a retreat if minimum number of participants are not met. 
  • If we cancel, you will be refunded your deposit in full or credit can be applied to a future retreat. 

Day Tours & All Other Services

  • We will provide no less than 48 hours notice for cancelling a day tour or other service if minimum number of participants are not met. 
  • If we cancel, your payment may be refunded in full. 

Minors

By reservation on behalf of any minors, you are deemed to be the designated contact person for every participant included on that reservation and take full responsibility for the accuracy of all information provided on their behalf. Each adult on a reservation with a minor or minor(s) is responsible for the behaviour, wellbeing, supervision and monitoring of such minor(s), and jointly and accepts these Terms for and on behalf of any minor(s) on their reservation, including all assumptions of risk and limitations of liability.

Shamasha’s multiday retreats may not be suitable for minors, please email or call Daphne to discuss prior to booking. 

Responsibility 

Shamasha acts only as an intermediary for the various independent suppliers that provide lodging, meals, transportation, sightseeing, activities or other goods connected with your retreat. You acknowledge that you are aware and clearly understand that these suppliers are independent contractors, are not managed by Shamasha and are not agents or employees of Shamasha. A supplier’s services are subject to the supplier’s own terms and conditions and the local laws and regulations of the relevant local community, provincial territory and country.  

Force Majeure 

Shamasha will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of Shamasha, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labour strikes, requisition, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances.

If Shamasha and/or any of its suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the retreat. 

Travel Insurance

The retreat price does not include any travel insurance. We strongly recommend that you purchase comprehensive travel insurance, covering trip interruption and cancellation (should you need to cancel your retreat with us), medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you during your retreat.

You agree to assume all costs of medical care and transportation in the event that you should require evacuation from a remote location. As such, we highly recommend that you purchase travel-related insurance if your current medical policy does not cover you during your travels in Newfoundland, Canada. 

We may require proof of coverage if you are visiting from outside of Canada. 

Pre-Departure Documentation

It is important that you carefully read all trip-related emails and documents that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 30 days of your receipt of those documents. 

A waiver of liability and assumption of risk agreement, a photo release, and, if required, a medical statement must be signed and submitted by you prior to your participation in any services. If you fail to submit this and other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.

Health Requirements and Medical Care

Our retreats can be physically active, with varying levels of demands and fitness requirements depending on the specific itinerary. By making a booking, you represent that you do not have any physical or other conditions that would create a hazard for you or other Participants or affect other people’s enjoyment of the retreat.

If you have a physical condition, dietary restrictions, or other conditions that will or may require special attention during the retreat you must inform us in writing when the booking is made using our Registration Form. We may require a medical note from your doctor if you have a special condition. We reserve the right in our sole discretion to accept, decline or remove anyone from a tour (at departure or during the tour) who we judge to be incapable of meeting the tour’s physical demands.  

Shamasha assumes no responsibility for any medical care provided to you. You agree to assume all costs of medical care and related transportation that are provided to you during the tour.  

Complaint Procedure

If you have a complaint during your retreat, you must promptly notify Shamasha or your retreat leader of the problem so that they can attempt to remedy the situation. Failure to do so while you are on the retreat will extinguish or reduce your ability to claim compensation from Shamasha. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.

If you are not satisfied after using this notice procedure, you must submit your complaint in writing to Shamasha within 14 days of the retreat’s end date. Shamasha will not accept any liability for claims received after this period.

Tour Start Date

It is your responsibility to be ready to embark on your retreat as specified in your online portal itinerary. Shamasha is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, early departures, mechanical failure of vehicles, poor driving conditions or road closures. 

Compliance with Local Laws and Tour Etiquette

You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of all assigned guides. The decision of the local guide or local supplier is final on all matters that may threaten safety or interfere with the well-being of others. 

During the tour, Shamasha has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the activities of the retreat; or b) who it determines to detract from others’ enjoyment of the tour; or c) who is destructive towards the local environment. 

Images Release  

You agree that Shamasha may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other travellers of you individually or in a group, in any medium, including but not limited to print, electronic media, video or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the retreat, you must inform us.

Limitation of Remedies  

You agree that the sole remedy for any default by Shamasha arising under this agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, Shamasha shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under the statute, in equity, at law, or otherwise, even if Shamasha has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.

Severability

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision. 

Successors and Assigns

This agreement shall inure to the benefit of and be binding upon Shamasha and the Participant and their respective heirs, legal personal representatives, successors and assigns.

Updating of Terms and Conditions 

Shamasha reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. 

Applicable Law and Choice of Forum

Any dispute arising out of this agreement, including all tort claims – whether such dispute arises in contract or in tort or otherwise – shall be litigated and determined, if at all, only before a court of competent jurisdiction in Newfoundland, Canada (and in no other).

Merger

This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.
